County Court Claims Explained

A clearer understanding of County Court claims, judgments and the steps involved in pursuing a claim.

County Court claims are used to resolve certain civil disputes, including situations where money is owed or an agreement has been breached.

Individuals and businesses can bring claims through the courts. If a money claim is successful, the court may issue a County Court Judgment (CCJ).

LegalWays provides practical support to help you understand the relevant procedures, available options and possible next steps.

What Is a CCJ?

A County Court Judgment is a court decision that may require someone to pay money owed.

Who Can Make a Claim?

Individuals, businesses and organisations may bring claims where there is a legal basis.

Understanding Response Periods

The time allowed for a response depends on the type of debt, the parties involved and the applicable pre-action rules.

INDIVIDUAL DEBT CLAIMS

30 Days

Where the Pre-Action Protocol for Debt Claims applies, a business claiming a debt from an individual, including a sole trader, must generally allow at least 30 days from the date of the Letter of Claim before starting proceedings if no reply is received.

Additional time may be required if the debtor responds, requests documents or seeks debt advice.

BUSINESS DEBT CLAIMS

Case Dependent

For debts owed by limited companies, the individual debt claims protocol generally does not apply.

Under the general pre-action rules, a reasonable response period is usually 14 days for a straightforward claim, although more complex cases may require longer.
