Understanding Response Periods
The time allowed for a response depends on the type of debt, the parties involved and the applicable pre-action rules.
30 Days
Where the Pre-Action Protocol for Debt Claims applies, a business claiming a debt from an individual, including a sole trader, must generally allow at least 30 days from the date of the Letter of Claim before starting proceedings if no reply is received.
Additional time may be required if the debtor responds, requests documents or seeks debt advice.
Case Dependent
For debts owed by limited companies, the individual debt claims protocol generally does not apply.
Under the general pre-action rules, a reasonable response period is usually 14 days for a straightforward claim, although more complex cases may require longer.
What information may be needed?
Where the Debt Claims Protocol applies, the letter must also be accompanied by the required Information Sheet, Reply Form and Financial Statement form.
